This Terms of Use shall be applicable to all web pages operated by and services of the COMPLAINTS BOARD.

The Website is offered to you conditioned on your agreement to the terms and conditions of this Terms of Use. Your use of the Website constitutes your agreement to all such terms, conditions, and any rules of conduct as COMPLAINTS BOARD may implement.

You may not use the Website in any manner which could damage, disable, overburden, or impair the Website or interfere with any other party's use and enjoyment of the Website. You may not sell or auction any accounts, characters, items or copyrighted material in or from the Website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Websites.

The following definitions apply:
Complaint message or complaint or message: is a personal opinion, perception, opinion, view of a consumer which may or may not be based on his/her own experience.
Consumer or User: the natural person or legal entity, such as but not limited to: individuals; partnerships; or corporations, whether or not in a represented capacity, as the user of the webpage and/or author of the message. The consumer represents and warrants that:
a. If an individual it is registering under his own name and the information provided is correct and accurate; consumer may not authorize, assign or otherwise transfer its user identification and email to any person or entity.
b. If a partnership, organization, entity or corporation the registrant is authorized to act on behalf of the partnership, organization, entity or company. Content: including texts, images, hyperlinks, audio and/or video files and/or other items
Use: including loading, logging in, requesting, consulting, reading, viewing, listening, editing, completing (forms), sending, (temporarily) copying, storing, forwarding, distribution, making use of services, performing legal acts.
COMPLAINTS BOARD is only a platform for consumers to post complaints; it is not responsible for the validity of consumer complaints posted to the website; it is not responsible for helping consumers resolve their complaints; it does not look-up or provides e-mail addresses for the subject businesses;
COMPLAINTS BOARD assumes that the intention of the consumers in posting their message is to allow them to ventilate their opinion, perception, view or concern thereby helping themselves, other consumers, and the subject business provide better products or services.
COMPLAINTS BOARD assumes that the complaint message posted by the consumer is a description of a situation, event or occurrence experienced by the latter. COMPLAINTS BOARD shall in no way be responsible for the way the content or complaint is perceived or interpreted by whoever reads it.
COMPLAINTS BOARD does not draw conclusions nor warrant the validity of the contents, it does not edit or censor posted messages or investigate the same for accuracy.
COMPLAINTS BOARD is not responsible for providing or helping to provide businesses’ responses to the consumer complaints that are posted on the COMPLAINTS BOARD and/or forwarding the same to the concerned businesses unless otherwise separately agreed in writing.

The Consumer/User:
1. Shall be responsible for the content of the message and to make sure that it is not contractually bound otherwise in discussing or posting a message to the COMPLAINTS BOARD;
2. Shall be responsible for the accuracy of any facts provided in the content of the message. COMPLAINTS BOARD does not knowingly allow incorrect or factually incorrect information to remain posted. If COMPLAINTS BOARD is instructed to remove and delete a posted message by a court or competent body or agency, the message will be removed or deleted.
3. Shall assume the risk and consequences for posting a message to the COMPLAINTS BOARD about the subject because the message is for public view.
4. Accepts and acknowledges that it may receive e-mail messages from others resulting from posting its message on the COMPLAINTS BOARD;
5. Accepts and acknowledges that COMPLAINTS BOARD does not prescreen or edit posted messages.
6. Accepts and acknowledges that posted messages are exposed to public view and are made available for indexing and reproduction by third-party search engines and directories. Consumer Board has no control over the content taken from the COMPLAINTS BOARD by third-party sites.

The Website may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, " Services"), you agree to use the Services only to post, send and receive messages and material that are proper and related to the particular Service and to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your name or email including the content of your transmissions through the Service. By way of example, and not as a limitation, you agree that when using a Service, you will not:
  • Upload, post, e-mail or otherwise transmit Content that infringes any third party rights, law, regulation or this Agreement;
  • Create a false identity, impersonate any person or entity, including, but not limited to, any employee, officer or representative of COMPLAINTS BOARD, its parent company, affiliates and subsidiaries, or falsely state or otherwise misrepresent your affiliation with any person or entity;
  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Service specifically allows such messages.
  • Conduct or forward surveys, contests, pyramid schemes or chain letters.
  • Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Service.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Interfere with or disrupt networks connected to the Service or violate the regulations, policies or procedures of such networks.
  • Attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or other means.
  • Interfere with another member’s use and enjoyment of the Service or another individual’s or entity’s use and enjoyment of similar services.
  • Violate any applicable laws or regulations.
COMPLAINTS BOARD has no obligation to monitor the Services. However, COMPLAINTS BOARD reserves the right to: review; monitor; retain materials posted to a Service; remove any materials in its sole discretion; and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request. COMPLAINTS BOARD reserves the right to terminate your access to any or all of the Services at any time without notice for any reason whatsoever.

The COMPLAINTS BOARD MEMBERSHIP AGREEMENT or “Agreement” forms a legal agreement between COMPLAINTS BOARD and:
  • You, in your personal capacity, in relation to:
    • The creation and administration of your account; and
    • Access to and use of the Services in your personal capacity; and
  • The company or other entity on whose behalf you are authorized to act (“Your Organization”), in relation to Your Organization’s access and use of any Services, in each case (“You”)
By clicking “I AGREE” below, you acknowledge that you have read, understood and agree to be bound by and comply with the terms of this Agreement. Please ensure that you have carefully read this Agreement, including any other documents incorporated by reference, including COMPLAINTS BOARD’s Terms of Use, Legal Information and Privacy Policy, prior to clicking on “I AGREE” below. If you do not agree to this Agreement, you may not register for membership or access or use any Services.
You may not enter into this Agreement or sign-up for a membership unless You are eighteen years old and above.

The USER ID is not transferrable to any other person or entity. You are responsible for maintaining the confidentiality and security of the password and for all uses of your User ID. You agree to:
(a) provide true, accurate, current and complete information about Yourself as prompted by the applicable registration forms; and promptly update this information as required to keep it true, accurate, current and complete.
(b) immediately notify COMPLAINTS BOARD of any unauthorized use of your password or of your User ID or any other related breach of security and ensure that You log out from the Services at the end of each session where such capability is provided to you. You acknowledge and agree that COMPLAINTS BOARD is not liable for any loss or damage whatsoever arising from Your use of your USER ID or Your failure to comply with the foregoing.

You may terminate your User ID by submitting a termination request to COMPLAINTS BOARD at any time.

Termination of User ID.
Subject to any terms as may be provided by COMPLAINTS BOARD Services, COMPLAINTS BOARD may terminate, in its sole discretion, without resort to summons, administrative hearings or initiating court proceedings, terminate or suspend your User ID for any reason whatsoever, including but not limited to:
  • breaches or violations of this Agreement or other agreements or guidelines incorporated herein;
  • requested by law enforcement or other government agencies;
  • unexpected technical or security issues or problems;
  • extended periods of inactivity
  • engagement by You in fraudulent, unlawful or illegal activities
Termination of your User ID will result in deletion of your password and termination or suspension of your User Id will result in restricting, limiting, suspending or barring of further or continued use of all or part of the Service. You agree that COMPLAINTS BOARD shall not be liable to You or any third party for any termination or suspension of your USER ID, or any restriction, suspension or barring of further or continued use of all or part of the Service.
